Terms of Service

Effective August 11, 2026 · PEFG, PLLC (Illinois)

These Terms of Service ("Terms") govern your access to and use of arcflashfiles.com and the products sold on it (the "Service"). By creating an order, uploading a document, or otherwise using the Service, you agree to these Terms.

1. The contracting party

The Service is owned and operated by PEFG, PLLC ("PEFG," "we," "us"). PEFG is the seller of record for every product on this Service, the counterparty to every Order, and the sole issuer of every report and every email you receive from the Service. No other person or entity — including any officer, member, employee, or contractor of PEFG — is a party to these Terms or bears any obligation to you under them.

PEFG separately offers engineering and expert witness work directly (see pefgconsulting.com). This Service's automated products are a distinct offering: they are not rendered as licensed professional engineering services, are not stamped or sealed deliverables, and do not create an engineer-client relationship — see the Disclaimer for the full scope of that distinction. powerengcalc.com is a separate, unrelated property referenced on this Service by outbound link only; using this Service does not make you a customer of it.

2. What you're buying

Every product on this Service is an automated preliminary document-review screening, described in full at /legal/disclaimer, which is incorporated into these Terms by reference. You are not buying a stamped or sealed engineering deliverable, a compliance determination, or an engineer-client relationship, regardless of which product or lane you select.

3. Accounts and eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the accuracy of the information you submit and for maintaining the confidentiality of your sign-in access.

4. Payment

Prices are shown and locked before you upload any document, via Stripe Checkout. All payments are processed by Stripe; PEFG does not store your payment card details. Payment terms for cancellations and refunds are governed by the Refund Policy.

5. Your documents

You retain all right, title, and interest in the documents you upload. By uploading a document, you grant PEFG a limited, non-exclusive, revocable license to process that document solely to perform the Service you purchased — running it through the review pipeline, generating your report, and complying with the retention and deletion obligations in the Data Retention Policy. PEFG will not use your documents to train, fine-tune, or improve any model, or as an example in any product or marketing material, without your separate written opt-in.

You represent that you have the right to upload the documents you submit and that doing so does not violate any third party's confidentiality obligations, intellectual property rights, or applicable law. If your documents are subject to an NDA with a third party, see /legal/nda.

6. Acceptable use

You agree not to:

  • Upload malicious files, or attempt to circumvent, disable, or interfere with the malware scanning gate.
  • Upload documents you do not have the right to share.
  • Use the Service to build a competing automated review product from its output.
  • Misrepresent a report produced by this Service as a stamped, sealed, or licensed engineering deliverable.
  • Attempt to reverse-engineer, scrape, or extract the underlying checklists or prompts.
  • Use the Service in a way that violates any applicable law or regulation.

PEFG may suspend or terminate access for any violation of this section.

7. No warranty

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. PEFG DOES NOT WARRANT THAT ANY REPORT IS COMPLETE, ERROR-FREE, OR SUITABLE FOR ANY PARTICULAR PROJECT, JURISDICTION, OR PURPOSE. YOU ARE SOLELY RESPONSIBLE FOR HAVING ALL FINDINGS INDEPENDENTLY VERIFIED BY A LICENSED PROFESSIONAL ENGINEER BEFORE RELYING ON THEM IN ANY WAY.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEFG, ITS MEMBERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY REPORT, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF PEFG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. PEFG'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or fraud.

9. Indemnification

You agree to indemnify, defend, and hold harmless PEFG and its members, officers, employees, and contractors from any claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising from: (a) your use of a report in a manner inconsistent with the disclaimer, including any use as a substitute for review by the Engineer of Record; (b) documents you upload that you did not have the right to share; (c) your violation of these Terms; or (d) any decision made or action taken in reliance on a report without the independent verification these Terms require.

10. No professional relationship through this Service

Nothing in these Terms, on this Service, or in any automated report creates an engineer-client, fiduciary, partnership, joint-venture, or employment relationship between you and PEFG or any individual associated with it. PEFG separately offers licensed professional engineering services and expert engagements outside this Service (pefgconsulting.com); nothing here limits or describes the terms of that separate, distinctly-engaged work.

11. Dispute resolution and governing law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Service will be resolved by binding arbitration administered under the rules of a mutually agreed arbitration organization, conducted in Illinois, on an individual basis only. YOU AND PEFG EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Either party may bring an individual claim in small claims court instead of arbitration where the claim qualifies.

12. Changes to these Terms

PEFG may update these Terms from time to time. Material changes will be reflected by a new effective date at the top of this page. Continued use of the Service after a change constitutes acceptance of the revised Terms.

13. Entire agreement; severability

These Terms, together with the Disclaimer, Refund Policy, Security Policy, Data Retention Policy, and Privacy Policy, are the entire agreement between you and PEFG regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full effect.
